Introduction and Acceptance of Terms

These Terms and Conditions ("Terms") govern access to and use of the Ghalia Brain AI chatbot service ("Service"), provided by Ghalia Boustani, based in Paris, France ("Provider", "we", "us", or "our").

By accessing, subscribing to, or using the Service through Telegram or any associated interface, you ("User") acknowledge that you have read, understood, and agree to be bound by these Terms.

If you do not agree with these Terms, you must not use the Service. The Service is intended for international users and operates as an online digital advisory tool.

Description of the Service

Ghalia Brain is an AI-powered chatbot designed to provide educational insights and strategic perspectives related to retail, luxury, and brand strategy. The Service operates via Telegram and uses artificial intelligence trained on frameworks, lectures, professional insights, and strategic methodologies developed by Ghalia Boustani.

The chatbot assists users in understanding topics such as:

  • Retail strategy and store innovation
  • Luxury customer experience
  • Brand positioning and storytelling
  • Business thinking within the retail and luxury sectors

The Service is designed as an informational and educational tool. It is not a substitute for professional consulting services.

AI Disclaimer

The responses provided by Ghalia Brain are generated by artificial intelligence systems. Users acknowledge and agree that:

  • All responses are automatically generated by AI technology
  • Responses are provided for informational and educational purposes only
  • The AI system may produce incomplete, inaccurate, or outdated information

Important Notice

The Service does not provide professional consulting, legal advice, financial advice, business advisory services, or investment advice. Any information provided by the chatbot should not be interpreted as professional advice. Users are solely responsible for verifying information and seeking professional advice where appropriate.

Limitation of Liability

To the fullest extent permitted by applicable law, the Provider shall not be liable for any direct, indirect, incidental, or consequential damages arising from the use of the Service, including but not limited to:

  • Business decisions made based on chatbot responses
  • Financial losses or strategic decisions taken by users
  • Errors, inaccuracies, or omissions in AI-generated responses
  • Business performance outcomes

The Service is provided "as is" and "as available" without warranties of any kind. Users agree that they use the Service at their own risk.

Subscription and Billing

€ 14/ month

Subscriptions are billed on a recurring monthly basis through third-party payment processors. By subscribing, users authorize the Provider and its payment partners to charge the subscription fee automatically.

How to Cancel

To cancel your subscription, send /cancel directly to the Ghalia Brain bot on Telegram. You will receive a secure cancellation link to manage or cancel your subscription instantly. No email required.

Cancellation will prevent future billing but does not retroactively refund past payments. Unless otherwise required by applicable consumer protection laws, subscription payments are non-refundable.

User Responsibilities

Users agree to use the Service lawfully and responsibly. Users must not:

  • Resell access to the Service or share access credentials
  • Share or distribute chatbot responses commercially
  • Scrape, extract, or harvest AI-generated responses at scale
  • Reverse engineer or attempt to replicate the AI system
  • Use automated tools to exploit the Service
  • Use the Service for illegal, fraudulent, or harmful purposes

Any misuse of the Service may result in immediate suspension or termination of access.

Intellectual Property

All intellectual property associated with Ghalia Brain remains the exclusive property of Ghalia Boustani. This includes strategic frameworks, educational concepts, methodologies, knowledge structures, training materials, branding and platform design.

Users are granted a limited, non-exclusive, non-transferable license to use the Service for personal use only. Users may not reproduce, redistribute, publish, sell, or commercialize chatbot responses without prior written permission from the Provider.

Data and Privacy

The Service may collect and process certain data necessary for its operation, including user account information, subscription data, conversation history, and interaction data. Conversation data may be stored in order to enable or improve AI memory and response quality.

The Provider processes personal data in accordance with the General Data Protection Regulation (GDPR) and applicable data protection laws. Users have the right to:

  • Request access to their personal data
  • Request correction of inaccurate data
  • Request deletion of their personal data
  • Withdraw consent for data processing where applicable

Requests related to personal data may be sent to the contact email provided in Section 12.

Account Termination

The Provider reserves the right to suspend or terminate user accounts at its sole discretion if these Terms are violated, the Service is used abusively, illegal activity is suspected, or system integrity is threatened. Termination may occur without prior notice in cases of serious violations.

Changes to the Terms

The Provider reserves the right to modify or update these Terms at any time. Users will be notified of material changes through the website, the chatbot interface, or email notifications where applicable. Continued use of the Service after updates constitutes acceptance of the revised Terms.

Governing Law

These Terms and Conditions shall be governed by and interpreted in accordance with the laws of France. Any disputes arising from the use of the Service shall fall under the jurisdiction of the competent courts in France, unless mandatory consumer protection laws provide otherwise.
